The problem
According to the final report of the Official Committee for the Assessment of the 2017 Labor Order, the abolition of staff representatives and CHSCT (Hygiene, safety and working conditions) cut the roots of the collective representation of staff by moving them away from real work (which deviates in practice always prescribed in theory) and weakened the protection of health at work. Thus, the CSSCT (Health, safety and working conditions commissions) that have succeeded CHSCT have very reduced coverage and prerogatives.
It is established that the removal of Dp and CHSCT has had negative consequences on the regulation of working conditions and health at work (F. Rey, C. Spieser, P. Thobois, L’E l’Etvia at work, a large loser in the 2017 ordinances, Report IRES, 2024).
The proposal:
To improve policies for prevention of occupational health damage, the election of “ Real work delegates “(Dtr), compulsory for companies and establishments from 50 employees, will make it possible to organize the speaking of employees on their real work, the rise in information and proposals for improvement on its organization as close as possible to the field. THE Dtr will sit, with representatives of management, in a security committee, conditions and deliberation of work “(CSCDT) which will meet every month.
How does it work ?
THE Dtr will be elected in the same way as the ancients Dp (staff representatives), on the union list in the first round. They will have attributions mixing those of Dp and CHSCT : they will lead surveys at real labor during complaints of employees, labor accidents or occupational health or environmental events, technical or organizational changes, but also in the normal course of the activity of work collectives. To do this, they will have a delegation time of 15 hours per month for this purpose. Each delegate for real work will animate, in his work unit, the monthly meeting of deliberation on work (cf. following proposal ; The 3 hours of this meeting are added to the 15 hours of delegation). The delegates will establish the agenda and write the reports, including the team’s proposals for the improvement of the organization of work and its health and environmental impact. They will present to the management these proposals during meetings of the CSCDT and will follow up. Management must present a reasoned response to each proposal within three months.
On what research work is the proposal founded ?
The labor sciences have established that employees and their representatives have an expertise located on their real work, which must in practice deviate from the prescribed work to be effective and safe: taking this expertise into real work is an imperative for the efficiency of prevention (Inrs). Indeed, many academic works show the usefulness of the representation of staff in terms of occupational health and safety (D. Walters, T. Nichols (EDS), Workplace Health and Safety: International PerspectivesPalgrave Macmillan, 2009).
How to implement ?
The creation of a new representative body of staff supposes a law. For large companies, the activity of CSCDTcloser to the field, must be articulated with that of CSEmore close to the places of strategic decision.
